TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern all services and products provided by Kate Drennan Photography (“KDP”, “we”, “us”, “our”).
By booking or purchasing any service or product, you (“client”, “you”) agree to be bound by these Terms.
We may update these Terms from time to time. The latest version will always be available on our website.
BOOKINGS & PAYMENTS
A booking is confirmed once a non-refundable retainer is paid, and a signed agreement is received.
All bookings are subject to availability and are secured on a first-come, first-served basis.
Final payment must be made by the due date listed on your invoice. Failure to do so may result in cancellation of your booking.
Prices are subject to change at any time, however, confirmed bookings will honour the agreed pricing at the time of booking.
CANCELLATIONS & RESCHEDULING
Retainers are non-refundable and secure your date.
Rescheduling requests will be accommodated where possible, subject to availability.
If KDP is unable to perform services due to illness, emergency, or circumstances beyond control, a replacement photographer or alternative solution will be offered where possible, or a refund provided in accordance with Australian Consumer Law.
COPYRIGHT & IMAGE USE
All images remain the copyright of Kate Drennan Photography in accordance with the Copyright Act 1968 (Cth).
Clients are granted a personal-use licence, allowing images to be:
– Downloaded
– Shared on personal social media
– Printed for personal use
Images must not be:
– Sold or used commercially
– Edited, altered, or filtered without prior written consent
– Submitted to publications or third parties without permission
Vendors may use images for portfolio and marketing purposes with appropriate credit. Commercial or advertising use may incur additional licensing fees.
MODEL RELEASE
By booking, you grant Kate Drennan Photography permission to use images for portfolio, website, social media, and marketing purposes.
If you prefer your images not be used, this must be requested in writing prior to your session, and may incur an additional fee.
IMAGE DELIVERY
Final edited images are delivered via an online gallery.
RAW (unedited) files are not provided.
Turnaround times are approximately:
– Portrait sessions: 2 weeks
– Events: 2 weeks
– Weddings: 6–10 weeks
ONLINE GALLERIES & STORAGE
Galleries are available for a limited time as specified in your collection.
Clients are responsible for downloading and securely storing their images.
KDP is not responsible for lost files once images have been delivered.
Gallery extensions may be purchased prior to expiry.
GIFT VOUCHERS
– Valid for 3 years from date of purchase (in accordance with Australian law)
– Not redeemable for cash or refundable
– Transferable but not replaceable if lost or stolen
– Subject to availability and standard booking terms
– Voucher value will be honoured, however package inclusions may change over time
WEBSITE & INTELLECTUAL PROPERTY
All content on this website, including images, text, branding, and design, is the property of KDP and may not be used without written permission.
LIMITATION OF LIABILITY
To the extent permitted by law, KDP’s liability is limited to the resupply of services or refund of the amount paid.
Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law, including guarantees that services will be provided with due care and skill.
KDP is not liable for:
– Delays or disruptions outside our control
– Loss or damage caused by third parties
– Unforeseen circumstances impacting the shoot
FORCE MAJEURE
KDP is not liable for failure to perform services due to events beyond reasonable control, including but not limited to weather, illness, government restrictions, or emergencies.
GENERAL
These Terms are governed by the laws of Western Australia, Australia.
